A new legislative framework published in the Official Gazette has introduced a 'minimum flat tax' standard for passenger vehicles, aiming to establish a flexible tax structure adaptable to future market dynamics and protect sectoral price equilibria.

Hybrid Tax Architecture: The New Floor for Vehicle Taxation

Prepared by the Ministry of Treasury and Finance under the 'Law on Amending Certain Laws and Decree-Laws', the application does not abolish the current relative taxation based on engine cylinder volume, motor power, and emission criteria; instead, it adds a robust lower limit mechanism to this system. Under the new structure, if the Special Consumption Tax (ÖTV) amount calculated based on the relative rate falls below the determined minimum flat amount, only this minimum amount will be collected. If the calculated amount exceeds the flat limit, the current relative system remains valid.

100,000 Lira Thresholds and Sectoral Exemptions

The limits and exemptions determined within the regulation introduce a clear distinction based on vehicle types:
  • The minimum flat tax amount for passenger cars and other motor vehicles primarily intended for human transport was set at 100,000 lira.
  • For (L) class vehicles (including some three and four-wheeled motor vehicles and ATVs) with an electric motor power of 4 kilowatts and above, the limit was set at 30,000 lira.
  • L class vehicles with electric motor power below 4 kilowatts, internal combustion engine vehicles, two-wheeled motorcycles, and agricultural and forestry tractors are exempt from the new application.
  • Administrative Flexibility and Market Equilibrium

    According to current market data, the relative tax amounts of vehicles currently on sale exceed the determined flat limits, indicating that it will not create a direct increase in prices or taxes in the short term. However, the law grants the President the authority to increase these flat amounts up to 10 times or decrease them to zero within the legal framework, providing a strong administrative tool against future sectoral changes. The regulation is designed not as a current tax hike tool, but as a measure against potential future inequalities in competition and developments that could disrupt the pricing structure.
    This regulation is considered a strategic step to increase predictability in the automotive sector and strengthen the state's hand against potential market fluctuations. The presence of such a flexible floor structure in taxation allows the pricing mechanism to be kept under control without collapsing during potential global supply chain crises or sharp movements in exchange rates. From a financial stability perspective, the existence of such a legal infrastructure is likely to trigger sector players to revise their risk management models and pricing strategies in the long run.
